
Terms of Service
TOS for Daisy's commissions.
By commissioning me for digital artwork, you're agreeing to the terms of service listed below:
1. General terms and disclaimers
a. Commissioner should provide all required materials and requirements when submitting request form.b. The artist and the commissioner should first settle on an accurate explanation and interpretation of the expected finished product before starting the commission.c. The Artist has the right to deny the commission for any reason.d. The artist is entitled to cancel or deny the art commission if the request contains any depictions of racism/sexism/hate or is meant to mock/ridicule an individual for no apparent reason.e. The artwork is a digital piece, which will be sent to you digitally. It is not a printed artwork in real life.
2. Payment and fees
a. The payment is due in full upfront, after the commission has been agreed upon.b. Do not send payments unless the artist has agreed to take your commission and asks for the payment.c. Payment is done through Paypal invoice using EUR.d. A rush fee might be charged for tight deadlines.e. Additional fees will be charged for excessive or major revisions/change requests after initial sketches have already been approved by the client.f. The exact prices for the fees described above vary depending on the complexity and price of the work. These will be discussed before the payment.g. Provide the artist with email linked to your Paypal for the invoice to be sent.
3. Refunds and Cancellation
a. Once the product has passed the sketch stage, a refund is not permitted.b. If cancelled during the sketch phrase, I will refund you 50% of the original price, which includes the Paypal fees.c. I reserve the right to cancel and refund the money for your commission at any time.d. You may not file a chargeback against me after you have given approval of the artwork.
4. Client Obligations
a. Write clearly what you want to commission.b. Provide multiple clear reference images or clear description for the character/subject. Moodboards welcome.d. It is your responsibility to provide the artist with all possible references for the art piece, failing to do so might make it so that the commission is not fully to your liking.e. Read trough the Commission Information and TOS with care.
5. Process and delivery
a. The size of the canvas varies depending on the subject and amount of characters.b. I will provide you with time schedule in which the commissioned work will be finished after sketch stage has been dealt with. This shouldn't go over 7 days, though, after the piece has been started and is first in the possible queue.c. I will inform the commissioner in case their piece will take longer to finish. Please understand if the deadline changes.d. During the drawing process, I will send multiple WIP screenshots of the work for the commissioner to look at and tell their opinion on. The contact will be maintained until the commission has been finished.e. Small fixes and changes are allowed during the painting process. However excessive amount of change requests will add an extra fee to your commission, unless it is something that I've simply missed due my own mistake.f. It is up to me what counts as major and minor fix/change. Don't hesitate to ask about them though!g. Once done, the completed artwork will be sent via email or discord DM as a high-resolution png file attachment. Please provide the artist with your email or discord handle when asked to.A jpeg or other type of file form will also be sent upon request.h. Revisions and fixes will not be permitted once the artwork has been finished and sent.
What you receive
You will receive the following after client approvals at the appropriate stages of the commission process. Images are always sent as 300 DPI PNGs unless another resolution/file type is requested.You will receive:a. Final artwork, digitally.
b. Any sketches if you so desire.
6. Copyright and Usage Policy
The Artist's signature may not be removed when reposting it on social media sites etc.Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.The artworks are strictly for your personal use, unless you purchase the commercial rights for them.

.For every commissioned artwork, the artist:a. Retains the right to own the copyright of the completed artwork unless the commissioner requests a commercial use of artwork (additional fee will be applied).b. Can promote services and products with the finished artwork anywhere.For every commissioned artwork, the commissioner is allowed to:a. Use the commissioned artwork for personal use unless agreed otherwise.
(Example: Upload it on all your social media profiles, forums, etc.)b. Print the artwork for personal use.c. Crop, resize the artwork for icons, banners, thumbnails, etc.d. Post the artwork to social media, with artist's credit clearly visible on the post.e. Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings..
For every commissioned artwork, the commissioner is NOT allowed to:a. Claim the artwork as yours.b. Remove watermark/signature.c. Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.d. Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.e. Reproduce the work commercially without purchasing the rights from the artist.
.Commercial Rights:For commercial use, you must purchase the rights from me at 300% the original price.
Credit is still required when using the work in any form commercially.
These rulesets and prices are liable to change
Upon reading this and sending me a commission request, signifies that you, as the commissioner, agree to all the terms listed above, and this agreement will take effect once the artist starts working on the commission.
